1. Agreement to Terms

By accessing and using PollZapper ("Service"), you agree to these Terms of Service ("Terms"). The Service is operated by PollZapper Inc. ("we," "us," or "our").

2. Definitions

• "Project": A collection of polls and associated data
• "Poll": A scientific survey created through the Service
• "Client User": A user with restricted access to view project results and reports
• "Analyst User": A user with permissions to analyze data and produce reports
• "Marketplace": PollZapper's digital marketplace for add-ons and seat packages

3. Subscription Plans

Subscription fees are billed monthly in advance. Changes to subscription tiers take effect immediately.

Usage Limitations

• Freelancer Plan: Up to 3 user seats, one device per session
• Enterprise Plan: Up to 30 user seats, unlimited devices
• Agency Plan: Unlimited seats and devices

4. Data Rights and Privacy

4.1 Data Ownership

You retain ownership of all polls, results, and reports created through the Service.

4.2 Data Processing

We process data according to:

• Applicable data protection laws
• Our Privacy Policy
• Specific geofencing requirements where applicable

5. API Usage

5.1 Rate Limits

• Enterprise Plan: 2 requests/second
• Agency Plan: Unmetered access

5.2 API Terms

Users must:

• Maintain API security
• Not exceed rate limits
• Use valid authentication

6. Intellectual Property

6.1 Service IP

We retain all rights to:

• Service software
• Platform architecture
• UI/UX elements
• APIs and documentation

6.2 User IP

You retain rights to:

• Poll content
• Custom reports
• Analysis results
• Generated data

7. Prohibited Uses

Users may not:

• Reverse engineer the Service
• Access unauthorized data
• Violate polling regulations
• Share credentials
• Circumvent limitations

8. Termination

We may suspend or terminate accounts for:

• Terms violation
• Payment default
• Harmful activities
• Legal requirements

9. Warranties and Liability

9.1 Service Warranty

Service provided "as-is" without warranties.

9.2 Limitation of Liability

Maximum liability limited to fees paid in last 12 months.

10. Changes to Terms

We reserve the right to modify these Terms with 30 days' notice.
